1. About us and these terms

These terms apply whenever you book or take part in a class, workshop, event or other service at Jala Yoga & Wellness (“we”, “us”, “the Studio”), or buy a membership, class pass or gift certificate from us.

The Studio is run by David Polalski, a sole trader trading as Jala Yoga & Wellness, at The Old Stables Brancaster Hall, Main Road, Brancaster, Norfolk, PE31 8AF. You can contact us at hello@jalayoga.co.uk

By booking, buying or attending, you agree to these terms, including the health declaration and studio etiquette in sections 11 to 14. If you book for someone else (for example as a gift), please make sure they have read and accepted these terms before they attend. If anything is unclear, ask us before you book.

Nothing in these terms affects your legal rights as a consumer.

2. Who can take part

• Classes are open to people aged 16 and over. If you are 16 or 17, you must have the permission of a parent or guardian before you book. By booking, you confirm that you have it, and we may ask to see written confirmation or to speak to your parent or guardian.

• Everyone must complete our Yoga and Pilates intake form before their first class.

• Our classes are designed for general wellbeing. They are not suitable for everyone, which is why the health declaration in section 11 matters.

3. Booking

• Classes are booked through our online booking platform, Gymcatch (https://gymcatch.com/app/provider/11770/events). Gymcatch is a third party and its own terms of use apply when you use it. Your booking is with us, so any questions about refunds or credits should come to us directly. Gymcatch cannot assist with refunds.

• Your booking is confirmed when you receive a confirmation email or see it in your account. Please check you have booked the correct class, date and time.

• Spaces are limited and allocated on a first-come basis. If a class is full, you’ll be able to add yourself to the waitlist. When a spot becomes available because of cancellation, whoever’s on the waitlist will be notified by email and will have 30 minutes to book on. First come, first serve. After that 30 minutes, anyone can book on.

• Our timetable may change from time to time. See section 8 for what happens if we change or cancel a class you have booked.

4. Prices, payment and offers

• Prices are shown on our website and booking platform in pounds sterling.

• Payment is taken when you book or buy, by card, Apple Pay or Google Pay through the booking platform. Memberships are paid by recurring card payment (see section 5).

• We may change our prices at any time, but a change never affects something you have already booked or paid for.

• Promotional offers, including launch and opening events, apply only to the dates, classes and conditions stated in the offer. They cannot be combined with other offers unless we say so, and there is no cash alternative. Unless the offer says otherwise, bookings made with a promotional price follow the cancellation rules in section 7.

5. Drop-ins, class passes and memberships

Drop-in classes. A drop-in is a single class, paid for when you book.

Class passes. A 10-class pass gives you 10 classes to use within 6 months of the date you buy it. Classes not used by the expiry date are lost. Passes are personal to you and cannot be shared, resold or exchanged for cash.

Single-class credits. A single-class credit is issued only as a refund, when you cancel a booking in time under section 7. It cannot be bought. It is valid for 3 months from the date you cancel, and any credit not used by then is lost.

Monthly memberships. A monthly membership gives you a set number of classes in each monthly billing period (currently 4 or 8 classes per month).

• Payment is taken automatically each month on the same date until you cancel.

• Unused classes do not roll over to the next month.

• To cancel, you must do so before your next billing date, through your account or by emailing us at hello@jala. If you cancel in time, no further payment is taken and your membership continues until the end of the period you have paid for. If you cancel after the billing date, that month’s payment has already been taken and is not refunded. This does not affect your 14 day right to cancel in section 9.

• There is no minimum term.

• If a payment fails, we may suspend your bookings until it is paid.

• If we change the price or the number of classes included, we will give you at least 14 days’ notice, and you can cancel before the change takes effect.

• We cannot pause memberships.

• Memberships are personal to you and cannot be shared.

If you cancel a class booked using a pass or membership, section 7 applies.

6. Gift certificates

• Gift certificates are sold at face value and can be used towards classes, passes and memberships. They cannot be exchanged for cash.

• A gift certificate is valid for 12 months from the date of purchase. Once it expires, we are not obliged to honour it.

• We cannot replace a lost or stolen certificate unless you can show proof of purchase.

• The person using a gift certificate must accept these terms and complete the intake form before attending.

• Section 9 (your 14 day right to cancel) applies to the purchase of a gift certificate.

7. Cancelling a booking

• You can cancel a booking through your booking platform account at any time.

• More than 24 hours before the class starts: your booking is refunded automatically. If you booked using a class pass or membership, the class is credited back to that same pass or membership and expires at the same time as it does. For a membership, the class returns to that billing period's allowance and can be used until the period ends. If you paid the drop-in rate by card, Apple Pay or Google Pay, you will be gifted a single-class credit that lets you book an alternative session.

• Validity of refunded credits: a single-class credit given for a cancelled drop-in booking is valid for 3 months from the date you cancelled.

• Less than 24 hours before the class starts, and no-shows: the class is forfeited and no credit is given. A late arrival who cannot be admitted (see section 10) counts as a no-show.

• The 24 hours is measured back from the scheduled start time of the class.

• Credits, not cash: all sales are final and we issue credits towards future classes only, not cash refunds for cancelled bookings. This does not apply where we cancel a class (section 8), where section 9 gives you a right to cancel, or where the law requires a refund.

• Exceptional circumstances: if you cannot attend because of something serious and unavoidable, such as illness, bereavement or an emergency, please contact us. We may make an exception at our discretion, but we are not obliged to.

• Any queries about refunds should come directly to us at hello@jalayoga.co.uk.

9. Your 14 day right to cancel

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, if you buy a class pass, membership or gift certificate online, you have the right to cancel the purchase within 14 days, without giving a reason.

• To cancel, tell us clearly in writing, for example by emailing hello@jalayoga.co.uk. You can use any wording, as long as it is clear that you want to cancel.

• We will refund you within 14 days of hearing from you, using the payment method you used to buy.

• If you asked us to start your membership or pass straight away and have already attended classes, we will deduct a fair amount for the classes you have used.

• This right does not apply to a booking for a particular class on a particular date, because it is a leisure service with a specific date of performance. That is why the cancellation rules in section 7 apply to bookings for specific classes.

Subject to this section and your other legal rights, all sales are final.

10. Arrival and lateness

To preserve the peace of the studio and for your safety (warming up matters), please arrive 10 minutes before the class starts. The studio doors close at the scheduled start time. Late arrivals cannot be accommodated. A late arrival is treated as a no-show: the class is forfeited and no refund or credit is given (see section 7).

11. Health, safety and your responsibility

11.1 Health declaration. By booking, you confirm that you are in good physical health and fit to take part in yoga and Pilates.

11.2 Tell us what we need to know. Before booking, please use the additional information box on the intake form to tell us about any of the following, and anything else you think your teacher should know:

• medical conditions

• recent surgeries

• high or low blood pressure

• injuries, such as to your back, neck or joints

• pregnancy, or being within 12 weeks postpartum (see section 12)

If your health changes, please update us before your next class. The declaration applies to every class you attend, and we may ask you to refresh it from time to time.

11.3 Listen to your body. You agree to practise mindfully, move within your physical limits and rest whenever you need to. Nothing in a class is compulsory. If you feel pain, dizziness, breathlessness or anything unusual, stop and let your teacher know.

11.4 Not medical care. Yoga and Pilates are not a substitute for medical care, and our teachers are not medical professionals. If you have any health concerns, it is your responsibility to consult your doctor before taking part. We may ask for medical clearance where we think it is sensible.

11.5 Teacher judgement. Teachers may offer modifications, suggest you rest, or ask you not to take part in all or part of a class if they reasonably believe it is unsafe for you or others. If we turn you away because of a health issue you had told us about, we will return the class credit.

11.6 Follow instructions. Please follow your teacher’s instructions and use mats, props and equipment as shown.

12. Pregnancy and postnatal

• If you are pregnant or within 12 weeks postpartum, please tell us in the additional information box before you book.

• We recommend you check with your midwife, GP or health visitor before starting or continuing classes, and after a caesarean birth or any complications.

• Please also tell your teacher at the start of each class so they can offer suitable modifications.

• Some classes may not be suitable. It is your responsibility to decide, with medical advice, whether a class is right for you.

13. Hands-on assists

Our teachers may occasionally offer gentle physical adjustments to support your practice. Touch is always optional. You can opt out at any time, before or during class, by telling your teacher. You will never be asked to explain why, and opting out will not affect how you are treated.

14. Studio etiquette and conduct

• Switch your phone to silent and keep it out of sight during class.

• Remove your shoes at the door and keep your belongings in the designated area.

• Please arrive clean, and avoid strong perfume or scented products out of consideration for others.

• Mats and props are provided at the studio and are included in the cost of your booking. You are welcome to bring your own mat if you wish. Our mats are made using natural and recycled rubber, if you have a rubber allergy, please bring your own mat.

• Be respectful and kind to teachers, staff and other students. We will not tolerate harassment, discrimination, aggressive behaviour or unwelcome comments.

• Do not attend under the influence of alcohol or drugs.

• We may ask you to leave, or refuse future bookings, if your behaviour affects the safety or enjoyment of others. In that case, no refund is due for the class.

15. Photography, recording and belongings

• Please do not take photos or recordings of other people in the studio without their consent.

• We may take photos or video in the studio for marketing only with the consent of anyone who appears in them, and you can say no without any effect on your booking.

• You bring your belongings into the studio at your own risk. We are not responsible for loss or damage unless it is caused by our negligence or breach of these terms.

16. Liability

16.1 Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that the law does not allow us to exclude or limit. Your legal rights as a consumer are not affected.

16.2 We will provide our services with reasonable care and skill, keep the studio and equipment in reasonable condition, and hold public liability insurance.

16.3 Physical activity carries some risk of injury, such as strains, sprains and falls. You accept the inherent risks of yoga and Pilates that remain despite our taking reasonable care, and you take part at your own risk to that extent.

16.4 We are not responsible for injury or loss to the extent that it is caused by you, for example because you did not tell us about a relevant health condition, you ignored your teacher’s instructions or advice, you misused equipment, or you broke these terms.

16.5 Subject to 16.1, we are responsible only for loss or damage that is a foreseeable result of our breaking these terms or our negligence. We are not liable for losses that could not reasonably have been predicted, or for any business or commercial losses.

17. Your information and privacy

  • We collect your name and contact details, booking and payment records, and the health and wellbeing information you give us on the intake form. Payments are processed through the booking platform and payment provider, and we do not store your full card details.

  • Health information is sensitive (“special category”) data under UK data protection law. By completing the intake form and ticking the consent box, you give us your explicit consent to use it only to teach you safely, keep our records and, if necessary, to help in an emergency. You can withdraw your consent at any time, but we may then be unable to let you take part safely.

  • We share health information only with the teachers who need it, and with emergency services if necessary. The booking platform also holds your data and handles it under its own privacy policy.

  • We keep your information for 6 years and then delete it, unless we are required to keep it longer.

  • You have rights under UK data protection law to see, correct and delete your data, to object to certain uses, and to complain to the Information Commissioner’s Office (ico.org.uk).

  • Our full privacy notice is at www.jalayoga.co.uk/privacy-policy.

  • We will send you marketing only if you have agreed, and you can unsubscribe at any time.

18. Complaints

If you are unhappy with anything, please tell us at hello@jalayoga.co.uk so we can put it right. We aim to reply within 2 working days and to resolve the matter within 14 days. This does not affect your legal rights.

19. Changes to these terms

We may update these terms from time to time. The version and date at the top show when they were last changed. Updated terms apply to bookings and purchases made after the change. If we make a material change to an ongoing membership, we will give you at least 14 days’ notice, and you can cancel before it takes effect.

20. General

  • Whole agreement. These terms, together with your booking confirmation and the intake form, are the whole agreement between you and us.

  • If part is unenforceable. If any part of these terms is found to be unenforceable, the rest will continue to apply.

  • No waiver. If we do not enforce a term straight away, that does not mean we give up the right to do so later.

  • Third parties. Only you and we have rights under these terms.

  • Events beyond our control. We are not responsible for delays or failures caused by events outside our reasonable control, such as severe weather, power or utility failures, or public health restrictions. If this happens, we will offer a credit or refund as set out in section 8.

  • Governing law. These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland, you can also bring a claim in the courts of the part of the UK where you live.
